TERMS AND CONDITIONS FOR SMS/TEXT VOTING

These are the terms and conditions of use established by enteryourvote.com, LLC for SMS (Short Message Service)/Text voting and reserves the right to amend the Terms and Conditions at any time.

ENTERYOURVOTE.COM LLC, does not and will not support the use of text voting for the purpose of contest, sweepstakes, and or any use of text voting where someone is to win something of value.

All marketing of text voting through the use of enteryourvote.com LLC must include the following on any and all marketing material;

Each text vote is .99 cents and standard rates apply. For HELP or STOP text the word HELP or STOP TO 73997. For all terms and conditions, please refer to terms and conditions at the website, enteryourvote.com.

HOW TO VOTE

To submit a vote by text message, the entrant must (a) be a subscriber of (i) T‐Mobile®, (ii) Verizon® Wireless, (iii) AT&T®, (iv) Sprint®, (v) Nextel®, (vi) Boost®, (vii) Alltel®, (viii) Cellular One™, or (ix) Virgin Mobile® (each, a Participating Wireless Carrier); (b) have a plan with such Participating Wireless Carrier that includes a text messaging service; and (c) use a wireless device that is capable of two‐way text messaging. This voting process is offered on an “as is” basis and may not be available in all eligible geographic areas at all times during the Voting Periods. This voting process may cease to be available to you in the event of product, software, coverage, or other service changes made by your Participating Wireless Carrier.

Proof of sending a text vote is not proof of receipt. enteryourvote.com, LLC is not responsible for nonreceipt of any SMS/Text message vote due to user error or any other reason.

The entrant’s wireless account will be charged 99 cents per valid vote. Any eligible person may vote as often as he or she wishes during the applicable Voting Periods. If you are not the bill payer for the wireless device, you must obtain the permission of the person responsible for paying the bill for the wireless device before you vote. You acknowledge that if you text outside the specified Voting Period your vote will not be registered but you may still be charged.

In addition to the charge per valid vote, standard text messaging rates of Participating Wireless Carriers apply to each text message sent or received, plus any other charges that your wireless service rate plan may impose. (Contact your Participating Wireless Carrier for pricing plans, text message charges, and other plan details).

All revenue generated from text voting is the sole property of enteryourvote.com LLC, and all carriers associated with enteryourvote.com LLC. enteryourvote.com, LLC reserves the right to keep all voting and text messages confidential.

To opt out of this voting process at any time, text “STOP” or “QUIT” to 73997 (enteryourvote.com. LLC).

VOTING PERIODS

enteryourvote.com, LLC and/or its sponsor(s) will determine and establish all Voting Periods.

VOTING RESULTS

All votes submitted become the sole property of enteryourvote.com, LLC and will not be acknowledged or returned once the text vote has been confirmed.

If, for any reason, any aspect of this voting process cannot be conducted as intended by enteryourvote.com, LLC and/or the sponsor(s), including as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical problems or system failures or disruption, ‘Acts of God’ or terrorist attacks, or any other causes beyond the control of enteryourvote.com, LLC that are likely to or actually corrupt or affect the administration, security, fairness, integrity or proper conduct of the voting process, then enteryourvote.com, LLC and the sponsor(s) each reserve the right at the sole discretion of either to cancel, terminate, modify or suspend the text messaging voting process. In the event of technical difficulties with the voting, enteryourvote.com, LLC reserves the right to review votes for accuracy and to take any appropriate action, including, without limitation, voiding votes cast during the time period(s) of such technical difficulties.

DISCLAIMERS AND RELEASE

You participate in this voting process voluntarily and at your own risk. You agree that enteryourvote.com, LLC, the sponsor(s), and their respective officers and managers, employees, agents, parent companies, affiliated companies, related companies, subsidiaries and advertising agencies, and any other entity involved in the development, administration or production of the voting process (collectively, “the Released Parties”) are not responsible for and shall not be liable for: (a) difficulty accessing telecom systems; (b) errors in transmission; (c) service outages or delays or for any human or other errors or problems of any kind or technical or electrical malfunctions of any computer, network,
telephone network or lines, computer on‐line systems, servers or providers, computer equipment, software, failure of email or players on account of any technical problems or traffic congestion on the Internet or at any web site or combination thereof; (d) any incomplete, lost, late, stolen, delayed, misdirected or garbled votes or failure to receive votes; (e) injury or damage to you or to any other person’s computer or wireless device related to or resulting from participating in, or downloading materials or software, or attempts to participate in or download materials or software related to this voting process; or (f) failures or malfunctions of phones (including wireless phones/handsets), phone
lines or telephone systems, cellular equipment towers, telephone systems or wireless services or other communications malfunctions. The Released Parties also are not responsible for and shall not be liable for: (i) any condition caused by events beyond the control of the Released Parties that may cause the voting to be disrupted or corrupted; (ii) typographical or other errors in the printing, the offering or the administration of the Voting Terms and Conditions; or (iii) any errors in the announcement of potential results.

Entrants assume all risk and liability for any injury or damages caused or claimed to be caused by their respective participation in the voting opportunity described in these Voting Terms, and release and hold the Released Parties harmless from any claim or liability of any kind arising in whole or in part, directly or indirectly, out of their participation in the voting process. Under no circumstances shall enteryourvote.com, LLC or its managers, representatives or agents be liable for any direct, indirect, special and/or consequential damages or loss whatsoever that might result from any use of, access to or inability to use or access the SMS/Text Voting service.

By participating in this voting process, you agree to be bound by these Terms and Conditions, as may be amended from time to time by enteryourvote.com, LLC, in its sole discretion and without prior notice. You also agree that  enteryoutvote.com, LLC, in its sole discretion, shall have the right to void any vote that appears to have been made by a person not meeting the eligibility requirements set forth in these Terms and Conditions, and reserves the right to permanently disqualify from voting any person it believes has violated these Terms and Conditions. Votes generated by a script, macro, robotic or other automated means are void and will be disqualified. Use of computer programs to vote and/or other automatic voting methods (such as hacks or bots), regardless of the method of voting is strictly prohibited, and votes submitted thereby are void and will be disqualified. enteryourvote.com, LLC reserves the right to disqualify, block or discard any votes of any person who enters by any kind of electronic, mechanical or other automated means or otherwise tampers with or hacks the voting process as determined by enteryourvote.com, LLC in its sole discretion. enteryourvote.com, LLC is not responsible for any damages to an entrant’s device that may occur from participating in the voting process. enteryourvote.com, LLC reserves the right, for any reason and in their sole discretion, to modify, suspend or discontinue the voting service without prior notice.

enteryourvote.com, LLC reserves the right to modify these Terms and Conditions at any time in its sole discretion and without prior notice All interpretations of these Terms and Conditions, and the decisions of enteryourvote.com, LLC relating to this voting process are final.

WARNING: Any attempt by any person to tamper with the voting process, or otherwise influence or undermine the voting process may be a violation of criminal and civil laws and, should any such attempt be made, enteryourvote.com, LLC reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law.
